Skywax Privacy Policy

The Effective Date of this Privacy Policy is October 12, 2007.

1. Skywax's Commitment to Privacy

Skywax.com ("Skywax") extends the following information to assure you (the "User") that Skywax is concerned about and respects Users' privacy. This statement discloses the information practices for the Skywax.com website, including what type of information is collected and how the information is used. To make this policy easy to find, Skywax makes a link to it available on all the publicly accessible areas of its website and at each point where personally identifiable information may be requested.

2. The Information Skywax Collects

A. Non-Identifiable Information

Skywax collects information through technology to make its site more useful to its Users. For instance, when a User comes to Skywax's website, Skywax may collect the User's IP address. An IP address is often associated with the portal through which a User enters the Internet, like the User's ISP (Internet Service Provider). Standing alone, the User's IP address is not personally identifiable. At times, Skywax may also use IP addresses to collect information regarding the frequency with which Skywax's guests visit various parts of its site.

Skywax may also collect anonymous information through the use of "cookies." A cookie is an element of data that a website can send to a User's browser, which may then be stored on the User's system. Some features of the Skywax website use cookies to better serve the User when the User returns to the Skywax site. The User can set its browser to notify the User before it receives a cookie, giving the User the chance to decide whether to accept it. The User can also set its browser to turn off cookies. If the User does so, however, some areas of the Skywax website may not function properly.

B. Personally Identifiable Information

Much of the personally identifiable information Skywax receives comes directly from Users who are creating an account with Skywax. Typically, this information includes, but is not limited to, visitor's name, postal address, e-mail address, and telephone number.

C. Payment Information

When a User purchases services from Skywax through Skywax's website, the User's credit card information, or other payment information may be collected to process payment. If a User elects to provide payment for services via recurring payments, the User's credit card information will be retained in Skywax's secure system.

If a user has completed an online transaction using a credit card, Skywax may request the User's permission to retain the User's credit card information to simplify future transactions and make communications about past transactions. When credit card or other payment information is retained, it is kept secure (in encrypted form) and separate from other demographic information the User may have given Skywax.

3. How User Information is Used

Skywax will use the information the User provides to process orders, provide services, and share product and service information with the User. In some cases Skywax may use a third party vendor to fulfill a specific request or obligation to a User. On occasion, when a new service Skywax believes a particular User may be interested in become available, the User may receive notice of the new service.

The User's information will not be disclosed to any third party except when Skywax deems it necessary to fulfill a specific request or obligation to the User or in order to comply with valid legal process such as a search warrant, subpoena or court order.

4. Skywax's Commitment to Data Security

The security and confidentiality of the User's information is extremely important to Skywax. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, Skywax has put in place appropriate physical, electronic, and administrative procedures to safeguard and secure the information Skywax collects online. From time to time, Skywax reviews its security procedures in order to consider appropriate new technology and methods.

Payment information is stored in an encrypted form in a secured database. Skywax uses high grade 128-bit Secure Socket Layers (SSL) encryption to protect the integrity of all payments and credit card transmissions to our servers. Skywax makes every effort to prevent unauthorized access to any and all information that Users may submit to Skywax's servers. Skywax cannot, however, guarantee that unauthorized access to this information will never occur. In the unlikely event that a breach in site security occurs, Skywax will notify the User of the matter directly.

5. Our Commitment to Children's Privacy

Protecting the privacy of children is especially important. The Children's Online Privacy Protection Act (COPPA) applies to the online collection of personal information from children under the age of 13. It is designed to ensure that parents are in control over what information is collected from children under 13. For that reason, Skywax never collects information at its website from those it actually knows are under 13.

6. Changes or Updates to Collected Information and Opting Out

The User may change or update the information that the User has provided Skywax by contacting Skywax at privacy@skywax.com or faxing (913) 681-2146. The User may also write to Skywax at: Attn: Privacy, WaXX, Inc., 12525 Antioch, Suite 102, Overland Park, KS 66213. To protect the User's privacy and security, Skywax will take reasonable steps to verify the User's identity before changing or updating any information.

The User may also choose to have its name taken off Skywax's correspondence list and, thus, cease to receive correspondence from Skywax by contacting Skywax through one of the channels listed in the preceding paragraph.

7. Changes to this Privacy Policy

From time to time, Skywax may collect different types of information and use that information in different ways - for example, when Skywax adds to the features or services available through www.skywax.com. In these cases, Skywax may edit this policy to explain the new practices. Because protecting the User's privacy is very important to Skywax, Skywax does not expect major changes in policy. However, if Skywax does make significant changes in its practices, Skywax will include announcements on the www.skywax.com home page so that Users will know to review the revised policy.
